These terms are long because the law asks for detail. This is what matters most, in plain words.
These Terms of Use (the "Terms") are the agreement between you and Textce ("Textce", "we", "us" or "our") for the Textce website at textce.com (the "Website") and the Textce apps and software (the "App"). Together the Website and the App are the "Service".
By downloading, installing or using the App, or by using the Website, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use Textce.
Because Textce has no accounts, there is no sign-up step. Using Textce is how you accept these Terms. If you are using Textce on behalf of a company, school or other organization, you confirm that you have the authority to accept these Terms for it.
Textce is a free client for Internet Relay Chat. It is software that runs on your device and connects you to IRC networks that other people and organizations run. It gives you a modern way to read and write messages, join rooms and manage your connections.
Textce also does not:
You also confirm that you have the legal capacity to enter into this agreement and that you are not barred from using the Service under the laws that apply to you.
Textce has no accounts and does not collect personal information, so we do not ask your age and we cannot verify it. By using Textce you promise that you meet this requirement. If you learn that someone under the required age is using Textce, we ask that you tell us. If a parent or guardian finds that a minor is using Textce, please stop their use and uninstall the App.
Many IRC networks and rooms have their own age rules, and some are for adults only. Those rules apply on top of these Terms.
This is the most important point in these Terms, so we say it plainly. Textce does not run, host, operate, moderate or control any IRC network, server or channel. Networks and channels are run by independent people and organizations who decide:
We have no control over any of that, and no ability to override it. We cannot read, change, delete or recover anything on a network. We cannot restore access if a network operator bans or blocks you, remove content from a room, or reveal who is behind a nickname. Those requests belong with the network operators.
When you connect to a network, you enter into a relationship with that network, under its own terms and rules. Textce is not a party to that relationship, and we are not responsible for it.
Because of that, we are not the publisher or speaker of any chat content and we are not responsible for it, including whether it is accurate, lawful, safe, respectful or appropriate for you. People on IRC can say things that are false, offensive, harmful, sexual, illegal or misleading. Others may impersonate people or organizations, share links or files that are unsafe, or try to scam you.
You use IRC and Textce at your own risk. See Etiquette and safety for practical advice, and remember that you control what you read, click, download and share.
Every network and every room can have its own rules, usage restrictions, terms of use and consequences for breaking them. When you connect to a network or join a room you agree to follow its rules. Network operators can remove or block anyone at any time, and they decide who can connect.
If a network or room removes you, that is between you and them. Textce cannot undo it.
Textce can connect to networks, servers, bots, services, websites, files and apps that belong to third parties. Examples include IRC networks and their web pages, network services such as account and channel registration bots, link previews, image hosts, and the websites behind links people post.
Third parties have their own terms and privacy practices, and we do not control them or review them. We are not responsible for them, for what they do, or for any loss or harm you suffer from using them. You should read their terms before using them. Always check a link or a file before you open it. Third-party names and logos belong to their owners, and we use them only to identify them.
A Session Keeper, also called an IRC bouncer (for example ZNC or Soju), is third-party software that keeps you connected to a network while your device is off. Textce can work with one, but we do not make, host or operate any, and we do not provide one as a service. If you or someone else runs one, that person is responsible for its security, availability, logs and content. See the Session Keeper guide.
Because we do not run networks or rooms and do not see chat content, we cannot investigate or remove what you see there. If you have a problem with a network, a room or another person:
Copyright or other legal complaints about chat content should go to the network or the person responsible for that content. We do not host chat content and cannot remove it.
To tell us about a bug or a problem with Textce itself, see Bug reports & contact.
You are responsible for everything you do with Textce. You agree not to use Textce, the Website or any part of the Service to:
Breaking this section is a serious breach of these Terms, and it may also break the law or the rules of a network. We may stop you from using the Website, and your right to use the App ends automatically if you breach it. Network operators may act on their own too.
IRC is an open network of rooms. Some rooms are public and some are private, and a room's name or topic may not describe what is said there. Rooms can contain adult language, adult topics and content that you find upsetting or unsuitable. Textce does not filter or rate chat content, and appearing in a list or search does not mean we have checked or approved a room.
You are responsible for the networks and rooms you choose to join, and for leaving any room that is not right for you. Please be careful with links, downloads, and offers that sound too good to be true.
You are responsible for the content you send. Textce does not claim ownership of it, and these Terms do not give us any license to use it, because we never receive it.
Think before you share personal information in a chat room, and do not share passwords, payment details, identity documents or anything you would not want strangers to read.
Textce is provided free of charge. Subject to these Terms, we grant you a personal, worldwide, non-exclusive, non-transferable, revocable license to download, install and use the App on devices you own or control, for your own personal use. You may not sell it or charge others for it.
Some parts of Textce may include third-party or open source software, which is licensed under its own terms. Those terms apply to that software instead of this section where they conflict.
All rights we do not expressly give you are reserved.
The Textce website is a static website. It has no user accounts, and you do not need to log in to read it. You may view it, link to it and share it for personal, non-commercial use. We may change, move or remove pages at any time. Pages may contain mistakes or be out of date, including lists of networks and channels, which are a snapshot collected from public information and refreshed on a schedule. You should not rely on the Website as legal, safety, technical or professional advice.
If you get the App from an app store or platform such as the Apple App Store, Google Play or another marketplace, you must also follow that store's terms and rules. For Apple-sourced software the following also applies:
Other app stores and platforms have their own rules. Those stores are not responsible for the App, and they are not part of these Terms.
We improve Textce all the time. We may add, change, pause or remove features, networks lists, the Website or the whole App, with or without notice, and we are not required to keep any particular feature. Updates may be installed automatically, and they are covered by these Terms. Textce may stop working with a network or device. You can always stop using Textce by uninstalling it.
We have no duty to provide maintenance, support, updates or a particular level of service. We try to fix problems, but Textce is free software and we make no promises about it.
Textce, its name, logo, design, text and software, are owned by Textce or its licensors and are protected by law. Using Textce does not give you ownership of them, and you may not use the Textce name or logo in a way that suggests we endorse you or your product, except where the law allows.
If you send us ideas, suggestions or feedback, you give us permission to use them without limit, without payment and without credit, and we have no duty to use them or to keep them confidential. Do not send us anything you consider private or secret, and do not send personal information that we have not asked for.
Textce does not ask you to create an account and does not ask you for personal information. The Website does not collect or sell personal information, and the App stores your settings, saved networks and nicknames on your own device. Our Privacy Policy explains this, including what our web host may log when you visit the Website.
Because we do not receive your chat content or keep accounts, we do not act as a controller or processor of the personal data you share with networks, and we generally have nothing about you to give to anyone else. If a lawful order asks us for information, we can only provide what we actually have, such as web server logs.
TEXTCE IS FREE SOFTWARE AND IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment and non-infringement. To the fullest extent the law allows, we exclude every condition and warranty that would otherwise apply.
We do not promise that Textce, the Website, or any network will be available, uninterrupted, timely, secure, error-free or free from viruses or other harmful code, that it will work on every device or with every network or server, or that it will meet your expectations. IRC works over the internet and over networks that are beyond our control, and we are not responsible for outages, delays, dropped connections, lost messages, or data loss on your device or on any network.
Nothing in these Terms limits any warranty or right that the law of your country gives you and does not allow to be excluded.
TO THE FULLEST EXTENT THE LAW ALLOWS, Textce, its contributors, owners, officers, volunteers, suppliers and licensors are not liable for any indirect, incidental, special, exemplary, punitive or consequential damages, or for any loss of data, profits, revenue, goodwill or business, or for personal injury or distress, arising from or connected with Textce, the Website, any network, any chat content, or any other person's acts, however caused and under any legal theory, even if we were told it could happen.
This includes anything that happens on an IRC network or because of chat content, links, files or other third-party services. We do not control them, and you use them at your own risk.
Because Textce is free, our total liability to you for all claims relating to Textce will not be more than the amount you paid us for it, which is zero. If the law does not allow that limit, our liability is limited to the smallest amount the law permits.
Some places do not allow some of these exclusions or limits, so they may apply to you only partly. Nothing in these Terms excludes liability that cannot be excluded by law, such as for fraud.
To the extent the law allows, you agree to defend and hold harmless Textce and its contributors from claims, losses and costs (including reasonable legal fees) brought by a third party and arising from your content, your use of Textce or any network, or your breach of these Terms or of the law. We will tell you about a claim if we can, and we may take part in the defense at our own cost. If you live somewhere that does not allow this, it applies only as far as the law permits.
You must follow all laws that apply to your use of Textce, including export control and sanctions laws. You may not use or download Textce if you are located in, or ordinarily resident in, a country or region under a comprehensive embargo, or if you are on a government list of prohibited or restricted parties. You are responsible for following the laws of the places you connect from and the networks you connect to.
You can stop using Textce at any time by uninstalling the App and closing the Website. There is nothing to cancel, because there is no account and nothing to pay.
Your right to use the App ends automatically if you breach these Terms or if you stop being eligible. We may also block access to the Website, remove the App or stop supporting it, in whole or in part, at any time, for legal, security, safety or business reasons, with or without notice. We are not liable to you for doing so. Sections that by their nature should continue (including sections 5, 6, 8, 13, 18, 20, 21, 22, 26 and 27) survive the end of your use.
We may update these Terms from time to time, for example when the law changes or when Textce changes. Because we have no accounts and do not hold your contact details, we cannot message you directly. Instead, we post the new version on this page and change the "Last updated" date at the top. For important changes, we will make the update clear on the Website. The new Terms apply from the date they are posted, and if you keep using Textce after that, you accept them. If you do not agree, stop using Textce. The latest version is always at textce.com/terms. Older versions stop applying once the new version is posted.
If you have a concern about Textce or these Terms, please tell us first, and we will try in good faith to sort it out informally. For problems with a network, a room or another person, contact that network or that person, not us.
These Terms, and any dispute that comes from them or from your use of Textce, are governed by the laws that apply where the Textce operator is based, without regard to conflict-of-law rules. Courts in that place have jurisdiction over disputes, although this does not affect any right you have as a consumer to bring a claim in the courts of your own country or to rely on the mandatory laws there.
For questions about these Terms, start with the Help Center. To report a bug or reach us, see Bug reports & contact.
Textce is only an IRC client. We do not run any IRC networks and we do not endorse any IRC channel. For a problem with a network or a channel, contact that network's staff.
